ELIGIBILITY: To be eligible to enter or win, entrant must be an individual 18 years of age or older who has reached the age of majority in his or her state of residence, and who is physically a legal resident of and owner of a home in the 50 United States (includes the District of Columbia) at time of entry and prize distribution. Void where prohibited by law. Employees of Lowe's Companies, Inc. (
"Lowe's" or
"Co-Sponsor"), Houzz, Inc. (
"Houzz" or
"Co-Sponsor"), GMR Marketing LLC (
"GMR"), and each of their respective agencies, parent companies, subsidiaries, affiliates, promotional partners, representatives, and promotion and other vendor agencies involved in this Sweepstakes (collectively
"Released Parties") and the immediate family (defined for the purposes of this Sweepstakes as parents, spouses, siblings, children) and household members of all such employees, are NOT eligible to participate in the Sweepstakes and/or win a prize. Sweepstakes is subject to all federal, state, and local laws and regulations.
HOW TO ENTER:To enter the $50,000 Dream Kitchen Sweepstakes Presented by Lowe's and Houzz (the
"Sweepstakes"), log on to www.houzz.com/lowes,
register for Houzz.com (no cost, no obligation), complete the Official Online Entry Form including first and last name, address, city, state, zip code,
daytime phone number, e-mail address, confirmation of age, confirmation of homeowner status, and acceptance of Official Rules and Lowe's and Houzz's
Privacy Policy, and click "Submit" between 12:01 a.m. Eastern Time (
"ET") on January 22, 2013 and 11:59 p.m. ET on February 11, 2013 ("Promotion Period").
All online entries must be received by 11:59 p.m. ET on February 11, 2013 to be eligible. Limit one entry per person/authorized e-mail account holder.
Incomplete or mechanically reproduced entries will be disqualified. Subsequent entries from the same individual will be disqualified from the Sweepstakes
and entrant may be barred from participation. Information provided in connection with the Official Online Entry Form will be collected by Co-Sponsors and
will only be used by Co-Sponsors and its service providers for the purposes of confirming your eligibility, communications with you about Sweepstakes
administrative matters or prizes, administering your participation in the Sweepstakes, and any related advertising or publicity. Any information provided
in conjunction with your registration to the Houzz website shall be governed by the Houzz terms and conditions www.houzz.com/termsOfUse and privacy policy
www.houzz.com/privacyPolicy.
PRIZE AND APPROXIMATE RETAIL VALUE:
One (1) Grand Prize: Grand Prize winner may choose one of the prize options below("Prize").
Grand Prize Option #1: $50,000 Kitchen Makeover: Includes $25,000 worth of kitchen products from Lowe's awarded in the form of Lowe's Gift Cards and $25,000
in remodeling and design services by Houzz that will include design, construction, and installation services ("Grand Prize Option 1").
Grand Prize Option #2: $40,000 Kitchen Makeover and $10,000 cash: Includes $20,000 worth of kitchen products from Lowe's awarded in the form of Lowe's Gift Cards, $20,000 in remodeling and design services by Houzz that will include design, construction, and installation services, and $10,000 cash awarded in the form of a corporate check intended to be used for tax expenses ("Grand Prize Option 2").
Design services for either Grand Prize Option 1 or Grand Prize Option 2 will be selected at the discretion of the Co-Sponsors with a designer nearest the winner's home. The Lowe's Gift Card prize will be awarded in multiple Gift Cards, which will equal $25,000 total if Grand Prize Option 1 is selected or $20,000 total if Grand Prize Option 2 is selected. Maximum Gift Card usage/redemption permitted in store or online is $10,000 in a single day. Lowe's Gift Cards are subject to state and federal regulations and are redeemable for merchandise only unless prohibited by law and cannot be used to make payments on any charge/credit account or used in conjunction with a previous sale. Lowe's Gift Cards may be redeemed online and have no expiration date.
Approximate Retail Value ("ARV") of each Grand Prize Option is $50,000.
Prize winner is responsible for all federal, state, and local income taxes and other taxes associated with the Prize (including any increase in property taxes that may be incurred as a result of awarding the Prize). Lowe's and Houzz will comply with all tax reporting requirements. Prize is non-transferable and no substitution is allowed except in Lowe's and Houzz sole discretion. Lowe's and Houzz reserves the right to substitute prize of the same approximate retail value. Prize consists only of items specifically listed as part of the prize. Certain conditions and restrictions apply. All costs and expenses not specified herein, related to any prize, and other expenses incurred by accepting the Prize are the sole responsibility of the Prize winner. Odds of winning depend on the number of eligible entries received.
GRAND PRIZE WINNER: Grand Prize winner will be selected in a random drawing from among all eligible entries on or about February 13, 2013 by GMR, an independent judging organization whose decisions on all matters relating the Sweepstakes are final. The potential Grand Prize winner will be notified by phone/e-mail/express mail to the phone number/address indicated on the entry on or about February 14, 2013. The potential Grand Prize winner (parent or legal guardian if potential Grand Prize winner is a minor in his/her state of residence) must complete, sign, and return as instructed an affidavit of eligibility, publicity release, liability release, background check authorization form, Personal Services Agreement, and required tax documents within
seven (7) calendar days following the date notification is received by potential Grand Prize winner or eligibility will be forfeited in its entirety and an alternate winner of the Grand Prize will be selected at random from among the remaining eligible entries received during the Promotion Period. Grand Prize winner may be subject to a background check. Co-Sponsors reserve the right, in their sole discretion, to disqualify a potential winner for any of the following reasons: (a) non-compliance with these Official Rules; (b) in the event that a Prize or Prize notification is returned as undeliverable; or (c) Grand Prize winner is not a homeowner. Winner is fully subject to verification of identity and eligibility, including home-ownership, to Co-Sponsors' satisfaction or alternate winner may be chosen, Grand Prize winner must schedule design services with Houzz within sixty (60) days after Grand Prize is awarded or design services will be forfeited and that portion of the prize will not be honored. Except where prohibited by law, acceptance of prize by winner constitutes the winner's consent that his/her name, likeness, voice and/or biographical data may be used for advertising and promotional purposes without further compensation and shall be deemed a waiver of all rights of privacy without limitation and without additional notice, compensation or consent.
PERSONAL SERVICES AGREEMENT: As a condition of prize award, potential Grand Prize winner may be required to negotiate and execute a personal services agreement ("PSA") with Co-Sponsors or alternate Grand Prize winner may be chosen. PSA will set forth Grand Prize responsibilities. The PSA may require, among other things, (1) that the Grand Prize winner permits the use of their name, likeness or identifying information for promotional, publicity or advertising purposes in any media including print and online media, without time or geographic limitations, and (2) that the Co-Sponsors have the right to but not the obligation to use remodel photographs of the Grand Prize winners home for future advertising.
ONLINE REGISTRATION: If for any reason the Sweepstakes, including the online portion, is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Sweepstakes, Co-Sponsors reserve the right at their sole discretion to disqualify any individual that Co-Sponsors or GMR deems responsible and Co-Sponsors further reserve the right to cancel, terminate, modify or suspend the Sweepstakes, and may determine an alternate method of prize award selection. Co-Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for or winning of a prize. Co-Sponsors are not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any e-mail or entry to be received by Co-Sponsors due to technical problem or traffic, congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes.
WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY CONSTITUTE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, CO-SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. CO-SPONSORS FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THAT PROVISION. Sweepstakes entries generated by a script, macro or other mechanical or automated means are ineligible and will be disqualified. All entries must include a valid e-mail address for the entrant. In the event of dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the "Authorized Account Holder" of the e-mail address submitted at the time of the entry. The "Authorized Account Holder" is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.
ADDITIONAL RULES, RELEASE OF LIABILITY: By submitting an entry, entrant agrees to accept and be bound by these Official Rules and agrees that any dispute with regard to the conduct of this Sweepstakes, rule interpretation, selection of winner or awarding of prize, shall be resolved by Co-Sponsors or GMR, whose decisions shall be binding and final. By entering, entrant agrees to be notified by e-mail or phone by the Co-Sponsors or GMR for the purposes of the administration of this Sweepstakes. By participating, entrant agrees to release and hold harmless Co-Sponsors, GMR, and each of their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents and representatives of any of the above organizations from liability of any kind or nature for any injury, loss or damage to person, including death or property damage or infringement of any right (intellectual property, publicity, privacy or otherwise) due in-whole or in-part, directly or indirectly to the acceptance, receipt, use, or misuse of a prize, participation in the Sweepstakes or any Sweepstakes-related activity. Co-Sponsors are not responsible for any typographical or other error in the printing of this offer, administration of the Sweepstakes or in the announcement of prizes, including such error as may give an erroneous indication that a prize has been won. In the event the Co-Sponsors are prevented from continuing with this Sweepstakes or the integrity and/or feasibility of the Sweepstakes is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within the Co-Sponsors control (each a
"Force Majeure" event), the Co-Sponsors shall have the right, in their sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes without notice or further obligation. If the Co-Sponsors, in their discretion, elect to abbreviate the Sweepstakes as a result of a Force Majeure event, the Co-Sponsors reserve the right, but shall have no obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event. All entries are the property of the Co-Sponsors and are not returnable.
